All provisions of the Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Offers and Pricing

We strive to provide our customers with valuable offers and fair pricing for our products. Our website may feature promotions, discounts, or special deals from time to time.

These offers are subject to availability and may have specific terms and conditions associated with them. We reserve the right to modify or withdraw any offers or pricing at our discretion. The prices displayed on our website are in USD and are exclusive of any applicable taxes or fees, unless otherwise stated.

Refund and Cancellation Policy

Digital Downloadable Products:

Refunds for digital downloadable products (such as e-books, guides, or software) are generally not available unless otherwise stated on the product page. We encourage you to carefully review the product details and features before making a purchase decision.

If you have any questions or concerns about a digital downloadable product, please reach out to our customer support team at support@sojourningscholar.com, and we will be happy to assist you.

Digital Services:

Our digital services (such as group coaching sessions or private consultation calls) are generally not subject to refunds. However, we do offer refund options for private consultation calls based on the cancellation timeframe:

Coaching Call Cancellation Policy:

  1. Full Refund: If you cancel a private coaching call at least 48 hours before the scheduled time of the session, you will receive a full refund of your purchase. 
  2. Partial Refund: If you cancel a coaching call within 48 hours of the scheduled time of the session, you will be eligible for a partial refund of 50% of the purchase price.
  3. No Refund: Please note that there will be no refunds for no-show appointments. If you need to reschedule a coaching call, please contact us as soon as possible to discuss alternative appointment options. We will make every effort to accommodate your request based on availability.

Shipping Policy

When you purchase our goods, either we or a third party will handle the shipping process. If a third party is responsible for shipping, the shipping will be subject to that third party's Terms of Service and other applicable policies. Please contact us to obtain information about the third party involved in shipping and access their relevant policies.

  2. We do not warrant that the products or services will be error-free, uninterrupted, or free from defects.

Testimonial and Feedback Policy

We reserve the right to use your testimonial in marketing materials without offering payment or any form of compensation unless specifically mentioned at the time of the testimonial request.

If you are participating in a program that offers incentives for providing a testimonial, please note that these incentives, such as gift cards, lifetime access to products, or private coaching sessions, are offered at our discretion and are available only to participants who meet our eligibility criteria.

To qualify for these incentives, you must provide a testimonial that adheres to the format and guidelines shared with you, and it must be submitted by the specified deadline. Incentives cannot be exchanged for cash and are non-transferable unless otherwise stated. Once your testimonial is received and approved, any associated incentives will be delivered within a specified timeframe.

By submitting a testimonial, you also agree to transfer all intellectual property rights to us. This means that we hold the rights to use and distribute your testimonial, and you waive any right to review or approve the final usage of the content. If your testimonial contains any personal information, rest assured that we will handle it in accordance with our Privacy Policy.

However, by providing a testimonial, you acknowledge that such information may be publicly shared. Only first names and the initials of last names are used in public marketing materials. 

We are not responsible for any damages, liabilities, or losses that may arise from your participation in any testimonial-related programs. You agree to release us from any claims that may result from the use of your testimonial. We take the integrity of testimonials seriously and adhere to legal guidelines regarding endorsements.

All testimonials must reflect genuine experiences. Any false or misleading testimonials will be rejected, and any associated incentives will be revoked.

In the event that a testimonial is found to be plagiarized or inauthentic, we reserve the right to revoke any incentives previously provided. Additionally, we retain the right to modify, remove, or choose not to publish any testimonial that does not align with our company’s values or is found to be inaccurate.

Remedies

You agree that the remedy for any breach of this Terms of Service in relation to your purchase shall be none. You further agree that any dispute arising from or relating to your purchase and this Terms of Service shall be resolved through the dispute resolution process outlined in the "Governing Law, Severability, Dispute Resolution, Venue, and Class Action Waiver" section below.

These remedies are intended to be your sole and exclusive remedies for any breach of this Terms of Service pertaining to your purchase. By accepting this Terms of Service, you acknowledge and agree that the limitations on remedies set forth herein are fair and reasonable.

General Disclaimer

Our Services are provided “AS IS.” and “AS AVAILABLE” basis. Sojourning Scholar and its suppliers and licensors hereby disclaim all warranties of any kind, express or implied, including, without limitation, the warranties of merchantability, fitness for a particular purpose and non-infringement. Neither Sojourning Scholar, nor its suppliers and licensors, makes any warranty that our services will be error free or that access thereto will be continuous or uninterrupted. You understand that you download from, or otherwise obtain content or services through, our Services at your own discretion and risk.

Jurisdiction and Applicable Law

Except to the extent any applicable law provides otherwise, the Agreement and any access to or use of our Services will be governed by the laws of .

The proper venue for any disputes arising out of or relating to the Agreement and any access to or use of our Services will be the state and federal courts located in .
